Cruise Ship Coronavirus Lawsuits

If you caught COVID-19 while on a cruise ship, or a loved one passed away after contracting the virus, you may have questions about whether the cruise line could be at fault. For instance, if the cruise line knew previous passengers had the virus, they may have been required to warn future passengers.

Lawsuits have already been filed by those who contracted the coronavirus or lost loved ones to this illness after becoming infected on a cruise ship.

Lawsuits Filed by Cruise Ship Passengers

Multiple lawsuits have been filed against Princess Cruise Lines over an outbreak on the Grand Princess ship – 21 people tested positive for the virus and passengers were quarantined in the ship off the coast of California.

The lawsuits allege the cruise line took a “lackadaisical approach” to keeping passengers safe. The Grand Princess had an outbreak of coronavirus on a previous voyage, and passengers had to be quarantined on the ship off the coast of Japan. There were approximately 700 cases of COVID-19 linked to this voyage.

Lawsuits also claim negligent screening of passengers, partly because the company knew about a COVID-19 outbreak on another of its ships, the Diamond Princess, just three weeks before the Grand Princess voyage. All passengers were asked to do was fill out a form indicating whether they were sick when they boarded the ship.

A couple in Arizona sued Costa Cruises after contracting COVID-19 aboard a cruise ship. Their lawsuit claims the crew knew a passenger had the disease but failed to require passengers to isolate in their rooms. After the ship docked it went on another 20-day cruise with some of the same passengers from the other voyage, according to the lawsuit.

Am I Eligible to File a Lawsuit?

There are many factors our attorneys need to consider as we try to answer this question, such as:

  • When employees knew passengers had the virus
  • Steps the cruise line took to limit the spread of the virus
  • When the cruise line warned passengers about a COVID-19 outbreak
  • Documents you signed before you boarded the ship and whether there were clauses that shield the company from liability
  • The cruise lines’ actions once the ship was docked
  • Damages you or your loved one suffered

We offer a free legal consultation to discuss the merits of your claim. If we validate your case, there is no obligation to move forward, so there is no risk to you in contacting us to discuss your situation.

Compensation for COVID-19 Victims

Each case is unique, so the compensation that may be available varies from case to case. However, generally, personal injury victims can pursue certain kinds of damages:

  • Medical expenses – These are the costs of your treatment for COVID-19, such as your stay in the hospital, medications and other medical interventions to fight the virus.
  • Lost wages – These are the wages you lost because you were unable to work due to your coronavirus infection.
  • Pain and suffering – This may include the physical pain and emotional suffering you endured because of the virus, such as the anxiety and fear that can be caused by contracting a life-threatening disease. This could include the anguish family members suffer after losing a loved one.
  • Funeral and burial expenses – If you lost a loved one to COVID-19, your lawyer may seek compensation for the cost of a funeral or burial.
  • Loss of companionship – If you lost your spouse to the virus, you may be able to seek compensation for the loss of this relationship.
  • Lost care, protection and guidance – Children who lose a parent lose the relationship, which involves care, protection and guidance.

At Gordon & Partners, we are dedicated to pursuing maximum compensation for injury victims. We know how important compensation can be as injury victims and those who have lost loved ones look to move forward from such a difficult situation.
