Defeat Device Software Used

Volkswagen has admitted it equipped almost 11 million vehicles worldwide with defeat device software that enables vehicles with a 2.0L TDI Clean Diesel engine to falsely pass strict U.S. Environmental Protection Agency (EPA) emissions standards tests.

The device turns on emissions controls while the vehicle is in a testing environment and then turns them off during regular driving conditions. This makes it appear as though the vehicle meets EPA standards while still providing consumers with touted green features and better performance. In reality, the Volkswagen clean diesel cars can emit up to 40 times the allowable limit of nitrogen oxide, a greenhouse gas.

The affected model vehicles include:

• 2009-2015 VW Beetle, Jetta and Golf
• 2009-2015 Audi A3
• 2014-2015 VW Passat

Another 75,000 vehicles with 3-liter V-6 diesel engines were also later determined to be affected. These larger luxury models and SUVs include model years 2009 through 2016. Some of the affected vehicles include:

• 2015-2016 VW Toureg
• 2015-2016 Audi A6, A7, A8 and Q5
• 2014-2016 Porsche Cayenne

Volkswagen Emissions Scandal

The EPA and California regulators were first warned of discrepancies in laboratory results and road tests in May 2014 due to studies conducted by the West Virginia University Center for Alternative Fuels, Engines & Emissions.

Volkswagen conducted its own tests into the matter and issued a voluntary recall that same year. However, it was not until September 2015 that Volkswagen admitted to using defeat devices to cheat the system.

Volkswagen has been ordered to fix all 500,000 clean diesel vehicles in the United States, though a recall has yet to be issued. Because the company intentionally defrauded environmental laws, it could face fines of up to $37,500 per vehicle, or more than $18 billion.

The company is considering a deal to buy back many of the diesel vehicles. However, this could only extend to some of the vehicles and may not include 3.0 Liter diesel models. Furthermore, the EPA has yet to approve any fixes Volkswagen has proposed.

Volkswagen lawsuits have already been filed across the country accusing the automaker of fraud and breach of contract, among other allegations.
