One of the biggest signs of neglect at health care facilities is bedsores. Scott has successfully resolved countless bedsore cases by settlement, binding arbitration and jury trials. In 2023, Scott obtained a $2,300,000 jury verdict against a nursing home in Gainesville, Florida for the development of a bedsore. Nursing homes and assisted living facilities often have families unknowingly sign arbitration agreements as part of the resident admission process in order to avoid jury trials. The facilities want arbitrations to be secretly resolved behind closed doors. When cases are submitted to binding arbitration, Scott fights just as hard for his clients in arbitration as he does in Court. Scott fought to establish that binding arbitrations should not be private or confidential and in 2024 Scott successfully brought the first ever binding arbitration case that was broadcast on the Courtroom View Network. In addition to bedsores, another major sign of neglect at health care facilities is falls. Scott has successfully resolved countless cases involving falls by settlement, binding arbitration and jury trials, including a recent jury trial he won in West Palm Beach, Florida against a hospital where Scott’s client fell out of a hospital bed and suffered a broken hip. Scott believes that every person’s life is valuable, including the most elderly members of the population. Scott recently conducted a three-week jury trial against an assisted living facility in Port St. Lucie, Florida for the wrongful death of a 97-year-old woman. The facility’s lawyers and experts claimed that the facility was not at fault for the death and that Scott’s client was at the end of her life expectancy. The jury agreed with Scott that elders have rights just like everyone else does and the trial resulted in a verdict of six million dollars for the 97-year-old’s wrongful death.
